Welcome to TILIX! These Terms of Service ("Terms") are an agreement between you and Pixelings ("we", "us", "our"), based in Poland, European Union. They apply to the TILIX mobile game, its website at tilix.pixelings.com and related services (together, the "Service").

By downloading, installing or playing TILIX, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Who can play

TILIX is a general-audience game. You must be at least 13 years old to create an account. If you are under 18, or under the age of majority where you live, you may use the Service only with the involvement of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Service, including any purchases.

2. License to play

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to download and play TILIX on devices you own or control, for your own non-commercial entertainment, in accordance with these Terms and the rules of the store you downloaded it from.

You may not copy, sell, rent, distribute, publicly perform or create derivative works from the game, its puzzles or its content, except as expressly permitted by law.

3. Your account

An account is optional. Without an account, your progress is stored only on your device and may be lost if you uninstall the game or change devices.

If you create an account:

• You must provide an email address you control. We send a one-time code to sign you in.
• You are responsible for keeping access to your email account secure, and for all activity under your account.
• Your account is personal and may not be sold, shared or transferred.

Nicknames

Your nickname may be visible to other players, including in the public Hall of Fame. It must not be offensive, hateful, sexual, misleading, impersonate another person or brand, infringe anyone's rights, or contain personal information such as a real full name, phone number or address. We may change or remove nicknames that break these rules.

4. Virtual items

TILIX includes virtual items and currencies such as coins, hints, lives, chests, stars, Golden Tickets, titles and the Premium Pass ("Virtual Items").

• Virtual Items are licensed to you, not sold. You do not own them and they have no monetary value.
• Virtual Items cannot be exchanged for real money, goods or services from us or anyone else, and cannot be sold, traded or transferred outside the game.
• The Premium Pass is a time-limited, non-renewing benefit. Its time starts running when you receive it and continues even when you are not playing. It does not renew automatically and is not a subscription.
• We may change, rebalance or discontinue Virtual Items, rewards, prices in coins, chest contents, drop rates and game rules, for example to keep the game fair and fun.
• Virtual Items may be lost if you delete your account, play without an account and lose your device data, or if your account is terminated for breaking these Terms.

Except as required by applicable law, Virtual Items are not refundable once delivered.

Chests and random rewards

Some rewards, such as chests, contain randomly selected Virtual Items. Chests are earned through gameplay and cannot be purchased with real money. The possible contents of each chest type are shown in the game.

5. Purchases

You can buy Virtual Items with real money through in-app purchases.

• Purchases are processed by Apple through the App Store and are subject to Apple's terms and payment policies. We do not receive or store your payment details.
• Prices are shown in the store before you confirm the purchase and may include applicable taxes.
• Purchased Virtual Items are delivered immediately after the store confirms the payment. If an item is not delivered, contact us with the purchase date and we will investigate.
• Refunds for App Store purchases are handled by Apple. You can request one at reportaproblem.apple.com.

Right of withdrawal (EU, EEA and UK consumers)

Virtual Items are digital content supplied immediately after purchase. By completing a purchase, you expressly request immediate delivery and acknowledge that you lose your 14-day right of withdrawal once delivery has started. This does not affect your rights if the content is defective or not delivered.

Parents and guardians

To prevent unwanted purchases by children, you can restrict in-app purchases in your device settings (for example, Screen Time on iOS).

6. Rewarded ads

You can choose to watch optional video ads to earn rewards, such as an extra life or a hint.

• A reward is granted only after the ad is completed, as reported by the ad provider.
• Ad availability depends on the ad provider, your region, your consent choices and your connection, and is not guaranteed.
• Ads are provided by third parties. We are not responsible for the content of third-party ads or websites they lead to.

7. Fair play

TILIX is about logic, skill and patience. To keep it fair for everyone, you agree not to:

• Use cheats, bots, scripts, automation, modified clients or any unauthorized software.
• Exploit bugs, glitches or errors to gain an advantage, Virtual Items or Hall of Fame recognition. If you find a bug, please report it to us.
• Manipulate your device clock or connection to obtain extra lives, rewards, daily challenges or Premium Pass time.
• Reverse engineer, decompile, extract or scrape the game, its puzzles or its solutions, except where this restriction is prohibited by law.
• Interfere with or attempt to gain unauthorized access to our servers, accounts of other players or the Service.
• Obtain Virtual Items through unauthorized sellers, chargeback abuse or fraudulent payments.

If we reasonably believe you have broken these rules, we may remove improperly obtained Virtual Items, reset progress, revoke titles, remove you from the Hall of Fame, or suspend or terminate your account.

8. Golden Tickets, titles and the Hall of Fame

• Golden Tickets are earned only by finding the official Golden Solution of a puzzle. Titles and a place in the Hall of Fame are earned only through gameplay and can never be bought.
• By earning a Hall of Fame place, you agree that your nickname, title and Golden Ticket count may be displayed publicly in the game and on our website.
• We may verify results, update the criteria for titles and the Hall of Fame, and correct or remove entries obtained in breach of these Terms or due to errors.

9. Content and intellectual property

The game, including its puzzles, levels, daily challenges, solutions, software, design, artwork, logos, music, sounds and texts, is owned by Pixelings or its licensors and is protected by intellectual property laws. "TILIX" and "Pixelings" and their logos are our trademarks.

Some components are provided under open-source or public-domain licenses (for example, CC0 sound effects and open-source libraries and icons). Those components remain subject to their own licenses.

If you send us feedback or suggestions, we may use them freely, without obligation to you.

10. Availability and updates

• Most of the game works offline. Some features, such as accounts, cloud save, the shop, ads and the Hall of Fame, require an internet connection.
• We may update the game, add or remove features, or require you to install updates to continue playing.
• We try to keep the Service running smoothly, but we do not guarantee that it will always be available, uninterrupted or error-free.
• We may discontinue the Service. If we do so, we will give reasonable advance notice in the game when possible.

11. Suspension and termination

You can stop using the Service at any time and delete your account in Settings › Account › Delete Account.

We may suspend or terminate your access if you seriously or repeatedly break these Terms, if required by law, or to protect other players or the Service. Where reasonable, we will tell you why. If we terminate your account without a valid reason, we will act in accordance with your rights under applicable consumer law.

12. Disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

Nothing in these Terms limits the statutory rights you have as a consumer, including legal guarantees of conformity for digital content under the law of your country.

13. Limitation of liability

To the maximum extent permitted by law, Pixelings will not be liable for indirect, incidental, special or consequential damages, loss of data, loss of Virtual Items or loss of profits arising from your use of, or inability to use, the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for in-app purchases in the 12 months before the claim.

These limitations do not apply to liability for death or personal injury caused by our negligence, for fraud, for intentional misconduct or gross negligence, or to any liability that cannot be limited or excluded under applicable law.

14. Apple App Store terms

If you downloaded TILIX from the Apple App Store:

• These Terms are between you and Pixelings only, not Apple. Pixelings, not Apple, is solely responsible for the game and its content.
• Your license to use the game is limited to Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for the game.
• If the game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the game, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the game.
• Apple is not responsible for addressing any claims by you or third parties relating to the game, including product liability claims, claims that the game fails to meet legal or regulatory requirements, or claims under consumer protection, privacy or similar laws.
• Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that the game infringes intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law and disputes

These Terms are governed by the laws of Poland, excluding its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts of your country of residence.

Before starting a formal dispute, please contact us at contact@pixelings.com so we can try to resolve the issue informally.

16. Changes to these Terms

We may update these Terms to reflect changes in the game, the law or our business. We will post the new version on this page and update the "Last updated" date. If changes are significant, we will notify you in the game before they take effect. If you do not agree with the updated Terms, you can stop using the Service and delete your account. Continuing to play after the changes take effect means you accept them.

17. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not transfer your rights under these Terms; we may transfer ours to a successor that continues to operate the Service, without reducing your rights.
